Privacy is a Right

    Know your rights. This is your first line of defense and your bases of what you should do and should not do. You can use this against others or it can be used against you, thus you should know where you are standing. Privacy is a right. Anyone should be aware that they are recorded, in document, audio, visual, etc. You as a data subject must be informed by anyone that want to record or gather data about you. Likewise, you should be responsible to inform other data subject if you will gather their data. Simple signage, or notice will do. For example, the “beware of dogs” can be consider since you are held responsible if someone that has been bitten by your dog, but the best example is the “this establishment is protected by CCTV” and “this site collects cookies” and the like. This is very simple yet very important. If anyone or an organization failed to implement or inform this notice, they are liable in the Republic Act 10173 or the Data Privacy Act of 2012.

    As a collector, you must ask permission first, it can be done by asking their signature, especially in face-to-face, or a pop-up or notice in the app or website, as a proff that they are informed and they are aware about your data privacy and collection statements.

    As a data subject, you can appeal if they have lapses about their data privacy statements or their implementation to their data privacy officer (DPO) and if not taken action, you can seek a legal help.
